Welcome to Dash. These Terms of Service ("Terms") govern your access to and use of the Dash platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
In these Terms, unless the context otherwise requires: (a) "Dash", "we", "our", or "us" refers to the Dash platform and its operator as identified in Section 2; (b) "Services" means the Dash platform, website, applications, APIs, and all related features and functionalities; (c) "User", "you", or "your" means any individual or entity that accesses or uses the Services; (d) "Account" means the registered account created by a User to access the Services; (e) "Subscription" means a paid plan that grants access to certain features of the Services for a specified period; (f) "Content" means any information, text, files, images, videos, or other materials uploaded, submitted, or displayed by you through the Services; (g) "Data" means any business data, customer information, analytics, or other electronic information processed or stored on your behalf through the Services.

By using the Services, you represent and warrant that: (a) you are at least 18 years of age or the legal age of majority in your jurisdiction; (b) you have the legal capacity and authority to enter into a binding agreement; (c) you are not barred from using the Services under applicable law; and (d) if you are using the Services on behalf of an organization, you have the authority to bind that organization to these Terms. If you do not meet these requirements, you must not access or use the Services.
By creating an Account, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional terms incorporated by reference. These Terms form a binding legal agreement between you and Dash. If you are using Dash on behalf of a business or entity, you represent that you have the authority to bind that entity. If you do not agree to all these terms, you must not access or use the Services.
To access certain features, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to keep your Account information updated at all times. One Account per person is permitted unless multi-account access has been expressly authorized by Dash in writing. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at support@sifrmind.com of any unauthorized access, security breach, or suspected compromise of your Account. We reserve the right to suspend, disable, or remove any Account that we reasonably believe is fraudulent, misleading, or created in violation of these Terms. We are not liable for any loss or damage arising from your failure to safeguard your Account.
Certain features of the Services require a paid Subscription. Fees, billing cycles, and payment terms are as described on our Pricing page, which is incorporated into these Terms by reference. By subscribing, you authorize us to charge your chosen payment method on a recurring basis. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your Subscription at any time through your Account settings or by contacting us. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that period expires. All fees are non-refundable except as expressly stated in our refund policy. All refund requests are governed by Dash's Refund Policy, which forms an integral part of these Terms. Late or failed payments may result in immediate suspension of access to paid features until payment is successfully processed. We may change Subscription fees with 30 days' prior notice. You are responsible for all applicable taxes, duties, and government charges associated with your use of the Services. Certain features, storage limits, or usage rates may be subject to the Subscribed plan, and Dash may adjust those limits with reasonable notice where practicable. Dash may modify or discontinue the free plan at any time. Free or trial plans may be subject to restrictions on features, capacity, or usage limits. Trial periods may be terminated or modified at any time in accordance with these Terms.
You retain all ownership rights to any Content and Data you upload, submit, or process through the Services. Dash does not claim any ownership over your Content or Data. By submitting Content through the Services, you grant Dash a worldwide, non-exclusive, royalty-free license to use, store, reproduce, process, adapt, display, and transmit your Content and Data solely for the purpose of providing, operating, improving, and securing the Services. This license continues for the duration of your Account and for a reasonable period thereafter to fulfill legal, backup, or regulatory obligations. Dash does not sell your Content or Data to third parties.
You are responsible for maintaining regular backups of your important Content and Data. While Dash implements reasonable technical and organizational safeguards to protect your data, we do not guarantee protection against all data loss scenarios, including hardware failure, software bugs, human error, security incidents, or force majeure events. Dash recommends that you maintain independent backups of all critical information. To the maximum extent permitted by law, Dash shall not be liable for any loss, corruption, or destruction of your Content or Data.
Dash and its licensors own all rights, title, and interest in the Services, including but not limited to the software, code, design, layout, logos, trademarks, trade names, and all intellectual property rights therein. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works of any part of the Services without our prior written consent, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction. Nothing in these Terms grants you any right, title, or interest in the Services or any Dash intellectual property.
We strive to provide reliable and uninterrupted access to the Services, but we do not guarantee that the Services will be available at all times without interruption or error. The Services may occasionally be unavailable due to scheduled maintenance, emergency updates, infrastructure failures, third-party service disruptions, internet outages, cyber attacks, or other events beyond our reasonable control. We will make reasonable efforts to notify you in advance of scheduled maintenance. Dash shall not be liable for any loss, damage, or inconvenience arising from Service unavailability.
You agree to use the Services only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You must not: (a) use the Services for any illegal, fraudulent, or unauthorized activity; (b) attempt to gain unauthorized access to Dash's systems, networks, or other user Accounts; (c) upload, transmit, or distribute viruses, malware, Trojan horses, or any other malicious code; (d) interfere with or disrupt the integrity, security, or performance of the Services; (e) misuse the Services to send spam, phishing messages, unsolicited communications, or otherwise violate applicable anti-spam laws; (f) scrape, crawl, spider, or data-mine any part of the Services through automated means without our express written permission; (g) circumvent any security measures, authentication mechanisms, or access controls; (h) reverse engineer, decompile, or disassemble any part of the Services except as expressly permitted by applicable law; (i) resell, redistribute, or sublicense access to the Services without prior written authorization; or (j) engage in any activity that places an unreasonable or disproportionately large load on our infrastructure. Additionally, you agree not to use the Services in violation of any applicable export laws, economic sanctions, or trade restrictions of any jurisdiction that apply to your use of the Services. Violation of these restrictions may result in immediate suspension or termination of your Account without notice.
Where Dash provides APIs, webhooks, or integration points, you agree to: (a) protect all API keys, tokens, and credentials and keep them confidential; (b) respect documented rate limits and not exceed usage thresholds; (c) use APIs and integrations only in accordance with our documentation and these Terms; and (d) not use automated access in any manner that could impair the functioning of the Services. We reserve the right to revoke API access at any time for violations of these Terms or for conduct that we determine, in our sole discretion, threatens the stability or security of the Services.
We take your privacy seriously. Our collection, use, processing, storage, and disclosure of personal data are described in our Privacy Policy, which is incorporated into these Terms by reference. We implement commercially reasonable technical, administrative, and physical security measures to protect your data, including encryption in transit and at rest, access controls, and regular security audits. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security against all threats. You are responsible for ensuring that any Content or Data you submit complies with applicable privacy and data protection laws. We process personal data in accordance with our Privacy Policy and applicable data protection regulations.
The Services may integrate with, link to, or enable access to third-party services, websites, applications, or products ("Third-Party Services"). Dash does not control, endorse, or assume any responsibility for the content, functionality, privacy practices, terms, or availability of any Third-Party Services. Your interactions with any third party are solely between you and that third party, and are governed by their own terms and privacy policies. We recommend that you review the applicable terms and policies before engaging with any Third-Party Services. Dash shall not be liable for any loss, damage, or claim arising from your use of or reliance on Third-Party Services.
Either party may terminate these Terms at any time. You may terminate your Account at any time through your Account settings or by contacting us. You may also request deletion of your Account through our support team. We may suspend or terminate your access to the Services immediately without prior notice if: (a) you violate these Terms or any applicable law; (b) we have reasonable evidence of fraudulent, abusive, or illegal activity associated with your Account; (c) your Account poses a security risk to the Services or other Users; or (d) required by law or regulatory authority. Upon termination, your right to access and use the Services ceases immediately. We may retain certain data for the period necessary to fulfill legal, regulatory, security, or fraud prevention obligations, in accordance with our Privacy Policy. Sections 7 (User Content & Data Ownership), 8 (Backup & Data Responsibility), 9 (Intellectual Property Rights), 13 (Data Privacy & Security), 15 (Suspension & Termination), 18 (Disclaimer & Limitation of Liability), 19 (Indemnification), and 24 (General Provisions) shall survive termination of these Terms.
Following termination of your Account, Dash may retain your Content and Data for a limited period as reasonably necessary to: (a) comply with legal or regulatory obligations; (b) enforce these Terms; (c) prevent fraud or abuse; (d) fulfill requests from law enforcement or government agencies; (e) maintain reasonable backup and archival records; or (f) resolve disputes. Following this retention period, eligible Content and Data may be permanently deleted or anonymized in accordance with our standard practices and applicable law. Dash is not obligated to return or provide copies of your Content or Data after termination.
Dash shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, internet service failures, cyber attacks, denial-of-service attacks, power outages, telecommunications failures, government actions, war, terrorism, civil unrest, labor disputes or shortages, and failure of third-party infrastructure or services. Our obligations under these Terms are suspended for the duration of any such force majeure event.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DASH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. DASH DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, ACHIEVE ANY PARTICULAR BUSINESS RESULTS, INCREASE REVENUE, GENERATE CUSTOMER GROWTH, OR OPERATE WITHOUT INTERRUPTION OR ERROR. IN NO EVENT SHALL DASH, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DASH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY WHERE PROHIBITED BY APPLICABLE LAW, INCLUDING FRAUD, DEATH, OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
You agree to indemnify, defend, and hold harmless Dash, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Services; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including but not limited to intellectual property rights, privacy rights, or contractual rights; (d) any Content or Data you submit, upload, or process through the Services; or (e) any dispute between you and another User. Dash reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
We reserve the right to modify or update these Terms at any time. We will notify you of material changes through reasonable means, which may include email notification, dashboard alerts, or announcements on our website. Changes become effective on the date specified in the notice, which will be at least 14 days after notification for non-material changes and 30 days for material changes, except where changes are required by law or to address urgent security or operational issues. Your continued use of the Services after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and may terminate your Account.
These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved through negotiation within sixty (60) days, either party may submit the dispute to the competent courts of Cairo, Egypt. Nothing in this section prevents Dash from seeking injunctive or equitable relief in any jurisdiction where necessary to protect its intellectual property rights or confidential information.
These Terms may be provided in multiple languages for your convenience. In the event of any conflict or inconsistency between different language versions, the English version shall prevail to the extent permitted by applicable law. We may provide any notice to you under these Terms by: (a) sending an email to the email address associated with your Account; (b) posting a notification on your Account dashboard; (c) publishing an announcement on our website; or (d) any other reasonable method of communication. Notices sent by email shall be deemed received twenty-four (24) hours after the email is sent, unless we are notified that the email was not delivered. You may provide notice to us by emailing support@sifrmind.com or by writing to our registered address. Your notices shall be deemed received when we confirm receipt in writing.
(a) Entire Agreement: These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Dash regarding your use of the Services and supersede all prior or contemporaneous agreements, communications, and proposals. (b) Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms and the remaining provisions shall remain in full force and effect. (c) No Waiver: The failure of Dash to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Dash. (d) Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Dash may assign or transfer these Terms freely, in whole or in part, without restriction. (e) Electronic Communications: By using the Services, you consent to receive communications from us electronically, including emails, dashboard notifications, and website postings, and agree that such electronic communications satisfy any legal requirement that communications be in writing. (f) Headings: Section headings are for convenience only and have no legal or contractual effect.
